Capital Projects Committee - Rock Harbor Dredge

Attendees: Wally Adams, Member, Board of Selectmen Sheila Vanderhoef, Member, Town Administrator Mike Hackworth, Member, Finance Committee
Neil Andres, Public Works Superintendent
Sheila Vanderhoef called the meeting to order and Neil Andres provided a project status report with an emphasis on the following points:
1) The vendor had unilaterally stopped work and removed equipment from Rock harbor before completing all contractual activity.
2) Performance of the vendor up to that time appeared to be good (but this was before the completion of the harbor survey) and there were not any indications that the vender would fail to complete the project on time and budget.
After responding to questions from members (primarily related to specifics of vendor performance, contractual obligations of the town and vendor, and the status of payments to the vendor) the following actions were agreed and that Sheila Vanderhoef and Neil Andres would report results at the next meeting:
1) Assessment/documentation of vendor compliance with obligations.
2) Communication with vendor to address failure to perform obligations.
3) Review of payments made and outstanding invoices from the vendor.
4) Review of all contractual agreements with the vendor and recommendations on the way forward.
The meeting was adjourned and it was agreed that the committee would meet when the actions noted above had been completed.
These minutes were approved by the two members attending the 5 January, 2015 meeting.
